Preemption is when a higher-level government limits or eliminates the power of a lower-level government to regulate a specific issue. Federal laws can preempt state and local laws, and state laws can preempt local laws.
It is used in many situations across the country including tobacco control, rent control, gun rights, minimum wage, and much more. Preemptive laws can be a barrier to something that would benefit the public. For example: a city may want to pass smoke-free ordinances but can’t if there is a state law prohibiting such.
